How the Divorce Process Works in Australia
Most divorces in Australia are handled online through the Federal Circuit and Family Court of Australia, and many are finalised without you ever setting foot in a courtroom. Here’s how it works.
1. Check you’re eligible. You need to have been separated for at least 12 months, have a connection to Australia and a copy of your marriage certificate. If you’ve lived under one roof during that time, the Court will need extra affidavit evidence.
2. Apply jointly or on your own. A joint application is made with your former spouse. A sole application only needs your signature. We prepare and lodge your application through the Commonwealth Courts Portal.
3. Serve the papers (sole applications). If you apply on your own, your former spouse must be formally served with a copy. If you can’t find them, the Court can allow substituted service or waive service altogether.
4. The Court hearing. Every divorce has a hearing, but you often don’t need to attend. For a joint application, or a sole application with no children under 18, you usually won’t need to be there. Where attendance is needed, our fixed fees include your lawyer attending on your behalf at no extra cost.
5. Your divorce becomes final. Once the Registrar makes the divorce order, it takes effect one month and one day later. From filing, the whole process usually takes around 3 to 4 months.
