Parenting Orders
Parenting Orders create legally binding obligations on parents to follow the terms specified in a Court Order made by the Federal Circuit and Family Court of Australia. Often, Parenting Orders may include:
- Who the child or children will live with;
- When they will spend time with the other parent;
- How and when the children may communicate with each parent;
- Arrangements for school holiday periods;
- Arrangements for special occasions such as Christmas, birthdays, Mother’s Day and Father’s Day;
- When and where child handovers will take place.
- Any other matter which is relevant to the child or children and in line with the provisions of the Family Law Act.
Essential Parenting Consent Orders
Our Essential Consent Orders will suit straightforward matters where the parties have reached an agreement about parenting arrangements.
Although every case is different, generally speaking a straightforward parenting arrangement will involve the following factors:
- Parents who have reached a clear agreement about care arrangements and do not have high conflict communication between them.
- If there is more than one child, the same set of arrangements will apply to all children.
- Where there are not significant issues of safety or risk of harm involving the children or the parties.
- Where the parties live in the same State or Territory and interstate travel orders are not required.
- Where the parties do not require orders for passports or international travel for the children.
- Where the parties do not require special orders dealing with special health or educational needs for children.
- Where there are no drug and alcohol issues requiring specific orders or ongoing management.
Advanced Parenting Consent Orders
In some circumstances, an agreement concerning the ongoing care arrangements for children may have specific issues or complex elements that require careful and considerate legal drafting by lawyers.
Parenting Orders will be considered ‘advanced’ or more ‘complex’ whenever there are issues which require specific attention and drafting in the agreed orders. These issues could include any matter which is required to be covered in the orders to provide a stable and safe routine for any children of the relationship.
Advanced Parenting Consent Orders may include, for example:
- Different time spending arrangements for multiple children of the relationship.
- Staggered or gradual increases in arrangements depending on when children reach a special milestone, such as commencing school, or after a specific period of time.
- Implementing strategies to reduce any potential risk arising from alcohol or substance abuse.
- Orders providing for one parent to have sole decision making (known as sole parental responsibility).
- International and interstate travel arrangements.
- Special medical or health needs of a child or children.
- Discharging or amending previous Court Orders.
