Parenting Plans
A Parenting Plan is a formal record of an agreement reached between parents concerning the care arrangements for their children, and is legally recognised once it has been signed and dated by the parties. However, it is important to note that Parenting Plans are not legally binding on the parties in the same way as Court Orders.
In some cases, a Parenting Plan may be useful for parties who wish to maintain flexibility with their care arrangements, rather than creating binding legal obligations.
Essential Parenting Plan
Generally speaking, a straightforward Parenting Plan may involve the following factors:
- Parents who have reached a clear agreement about care arrangements and do not have high conflict communication between them.
- There is a clear agreement about where the children will live and how much time they may spend with the other parent.
- If there is more than one child, the same living and care arrangements apply to all children.
- There are no significant issues of safety or risk of harm involving the children or the parties.
- The parties do not require orders for passports or international travel for the children.
- The parties live in the same State or Territory and interstate travel orders are not required.
- Special provisions dealing with special health or educational needs for children.
- There are no drug and alcohol issues requiring specific paragraphs or ongoing management.
Advanced Parenting Plan
In some cases, there may be complicated issues at hand in a matter which require careful consideration, drafting and legal advice. Parenting Plans will be considered ‘advanced’ or more ‘complex’ whenever there are issues which require specific attention.
These issues could include any matter which is required to be covered in the orders to provide a stable and safe routine for any children of the relationship who are covered by the orders.
Advanced parenting plans may include, for example:
- Staggered or gradual increases in arrangements depending on when children reach a special milestone, such as commencing school, or after a specific period of time.
- Different time spending arrangements for multiple children of the relationship.
- Implementing strategies to reduce any potential risk arising from alcohol or substance abuse.
- International and interstate travel arrangements.
- Special medical or health needs of a child or children.
