Divorce Application
Applying for divorce is a legal process that ends a marriage. It doesn’t resolve parenting or property matters, but it’s often the first step in finalising your separation.
At Family Law Resolutions, we make the divorce application process clear and manageable. Whether you’re applying solely or jointly, we guide you through each stage with practical advice, fixed fees, and support you can rely on.
When Can You Apply for Divorce?
You can apply for divorce in Australia if:
- You’ve been separated for at least 12 months
- At least one person considers the marriage to be over
- You or your spouse is an Australian citizen, permanent resident, or has lived in Australia for at least 12 months
- You have a copy of your marriage certificate (with translation if not in English)
You can apply as a sole applicant or as a joint applicant with your former partner. If children under 18 are involved, the court must be satisfied that proper arrangements are in place before granting the divorce.

Our Approach to Divorce Applications
We take the stress out of applying for divorce by handling the legal process from start to finish. Whether you’re applying on your own or with your ex-partner, we’ll make sure everything is done properly and on time.
Here’s how we support you:
- Confirm your eligibility and help gather required documents
- Prepare and file your application with the Federal Circuit and Family Court of Australia
- Represent you at the hearing if needed (especially for sole applicants or where children are involved)
- Keep you informed at every step with clear communication and fixed fees
Our goal is to make your divorce application simple, affordable, and fully compliant with the law.
What Happens After You Apply for Divorce?
Once your application is filed, the court will set a hearing date, usually within a few months. If it’s a joint application and there are no children under 18, you likely won’t need to attend the hearing.
For sole applications or where children are involved, you may need to appear in court. We’ll guide you through what to expect and represent you if required.
If the court is satisfied that all requirements are met, the divorce will be granted. It becomes final one month and one day after the hearing date.
We make sure every step is handled properly so there are no delays in finalising your divorce.
