What Are Your Rights Under Australian
Child Custody Laws?
Australian family law uses the terms parenting arrangements and parenting orders rather than child custody. These cover where children live, time spent with each parent and responsibility for major decisions.
Under the Family Law Act 1975, the child’s best interests guide parenting decisions, including their safety, wellbeing and relationships. Since May 2024, there is no longer a presumption of equal shared parental responsibility or an automatic right to equal parenting time.
Our Adelaide child custody lawyers can explain how these laws apply to your circumstances and help you understand your options.
Parenting Plans vs Parenting Consent Orders
Separated parents can record their parenting arrangements through a parenting plan or parenting consent orders. Both can address similar matters, but they have different legal effects.
Parenting Plans
A parenting plan is a written agreement signed and dated by both parents. It can cover where children live, parenting schedules, holidays, communication and responsibilities for important decisions.
Parenting plans offer flexibility and can be updated as circumstances change, provided both parents agree. They are not legally enforceable court orders.
Parenting Consent Orders
Parenting consent orders are agreements approved by the Court and made into legally binding orders.
They can cover the same practical arrangements as parenting plans but provide greater legal certainty because the Court can enforce them if a parent does not comply.
Consent orders may be appropriate where parents want formal arrangements or have experienced disagreements about following an existing agreement.
Family Law Resolutions can help you decide which option suits your circumstances, prepare the documents and apply for consent orders where required.
What Happens if You Cannot Agree on Child Custody?
If you and your former partner disagree about your children’s care, there are several ways to work through the dispute.
Many parenting matters can be resolved without contested court proceedings. The appropriate process will depend on the issues involved, whether both parents are willing to negotiate and any concerns about your children’s safety.
1. Negotiation
Our lawyers can negotiate with your former partner or their legal representative to help reach an agreement on parenting arrangements, with your children’s best interests in mind.
2. Family Dispute Resolution
An independent practitioner helps parents discuss their disagreements and work towards an agreement. This is generally required before applying for parenting orders, although exceptions apply for certain circumstances, including family violence and urgent matters.
3. Court Proceedings
If an agreement cannot be reached, court proceedings may be necessary. Our lawyers can help you prepare your case and seek parenting orders that reflect your children’s best interests.
If negotiations have broken down or you are concerned about your existing arrangements, seeking legal advice early can help you understand your next steps.

FAQs
Can my ex stop me from seeing my child?
Your former partner generally cannot disregard existing parenting orders simply because they disagree with them. If there are no court orders in place, your legal options will depend on the circumstances, including any safety concerns.
If your former partner is preventing contact with your child, a family lawyer can help you understand your rights and whether negotiations, mediation or court proceedings may be appropriate.
Can I get sole custody of my child in South Australia?
It is possible for a child to live primarily or exclusively with one parent. The Court can also allocate sole decision-making responsibility for major long-term issues where appropriate.
There is no automatic entitlement to sole custody. The Court considers the child’s best interests, including safety, individual needs and family circumstances. A child custody lawyer can advise you on the arrangements you may be able to seek.
Does the mother automatically get custody in Australia?
No. Australian family law does not automatically favour mothers or fathers when determining parenting arrangements.
The Court focuses on the child’s best interests rather than a parent’s gender. This includes considering the child’s safety, care needs and relationships with significant people.
Each family’s circumstances are assessed individually, and equal parenting time is not automatically required.
Can I change an existing parenting order?
Yes, parenting orders can be changed in certain circumstances. If both parents agree, they may be able to apply for new consent orders.
If you need the Court to reconsider final parenting orders and the other parent does not agree, you will generally need to establish a significant change in circumstances and satisfy the relevant legal requirements.
Our family lawyers can review your existing orders and advise you about your options.
Do I have to attend court for child custody arrangements?
Not necessarily. Many parents reach agreements through discussions, legal negotiations or family dispute resolution.
If both parents agree, parenting consent orders can generally be submitted for court approval without attending a hearing.
If an agreement cannot be reached, or there are urgent safety concerns, court proceedings may be required. Our lawyers can explain the available options based on your circumstances.
What is a parenting plan?
A parenting plan is a written agreement between separated parents that outlines arrangements for their children’s care. It can cover living arrangements, time with each parent, school holidays and important decisions. Parenting plans must be signed and dated by both parents but are not legally enforceable court orders.

How does the Court determine what is in a child's best interests?
The Court considers several factors when making parenting orders, including the child’s safety, developmental and emotional needs, and relationships with parents and other significant people, where safe. Every decision focuses on arrangements that best support the individual child.

How are child custody arrangements handled during school holidays?
School holiday arrangements can be included in parenting plans or court orders, covering how children spend Christmas, Easter and other school breaks with each parent. If disagreements arise, parents may need to negotiate changes or seek legal advice about their existing arrangements.
